A Clendenin man will remain in jail without bond on charges of first-degree murder and malicious wounding.
Kanawha County Circuit Court Judge Joanna Tabit on Thursday denied a motion to set bond for Randall Douglas Woods, 62, who is accused of shooting two of his neighbors on Aug. 23, killing one and injuring the other.
Woods' attorneys filed a motion requesting Tabit set a $100,000 bond and allow Woods to be released from jail and placed under home confinement, where he could stay with his wife, saying Woods' age and health rendered him in no condition to stay at the South Central Regional Jail.
David Elmore, 31, died in the 3900 block of Laurel Fork Road, and Cora Elmore, 38, suffered a gunshot wound to her arm after Woods was alleged to have fired one shot into their vehicle just after 1 p.m. Aug. 23, according to the criminal complaint filed in Kanawha County Magistrate Court.
Woods admitted to firing his 9mm gun into the truck, and he was arrested that day, according to the complaint.
According to court records cited during Thursday's hearing, there was a history of animosity between Woods and the Elmores that rose to the level of criminal charges, dating at least back to 2011.
Woods was charged with felony malicious wounding and wanton endangerment in 2011, when he was alleged to have rammed his pick-up truck into an ATV that was driven by Joseph Elmore, according to past Gazette-Mail reports.
Past reports also show David Elmore was arrested in 2012 for allegedly attacking Woods with a metal pipe during an argument.
On Aug. 23, Cora Elmore told a Kanawha County Sheriff's Deputy she and David Elmore were traveling in a pickup truck on Laurel Fork Road when Woods approached them on an ATV and "started mouthing and carrying on," Sgt. S.D. Ferrell said in the criminal complaint.
David Elmore reportedly sprayed Woods with bug spray, and Woods is alleged to have responded by firing one shot into the truck, Ferrell said. The bullet struck Cora Elmore in her forearm, and David Elmore suffered an injury to his chest, Ferrell said. Woods reportedly drove away from the scene on the ATV, Ferrell said.
Bystanders performed CPR on David Elmore as he lay in the roadway before deputies arrived to Laurel Fork, but he died at the scene, Ferrell said.
Another person told investigators that prior to the fatal shooting, Woods had threatened him and fired a single shot at him, Ferrell said in the complaint.
On Thursday, Tabit said because of Woods' criminal history, even though he never was convicted, she was not inclined to set a bond and allow him to return home.
"Under the circumstances, by virtue of the fact that this was a capital offense that is a murder, that -- I am looking at the charges, albeit they were just charges -- that behavior and conduct escalated to the point that someone was killed," Tabit said.
