An Elkview man who allegedly caused a fatal car crash while under the influence of drugs was among 67 people indicted by a Kanawha County last week.
Kevin Layne Statts, 55, was indicted on charges of driving under the influence causing serious bodily injury and driving on roadways laned for traffic, according to a news release from Kanawha County Prosecuting Attorney Charles Miller.
Statts allegedly crossed into another lane while driving on Frame Road in Elkview on May 31 and crashed into a vehicle driven by James Kidd, who died at the scene, according to a criminal complaint filed in Kanawha County Magistrate Court.
Police said in the complaint there were no skid marks or other evidence to suggest Statts attempted to avoid the crash, and Statts registered a blood-alcohol level above .08 percent, the legal limit. He allegedly tested positive for amphetamines, opiates, ecstasy and benzodiazepine.
At the time of the crash, Statts was under supervised release from prison. Statts was convicted of conspiracy to manufacture methamphetamine and possession of a firearm in furtherance of a drug trafficking crime, and he was sentenced to 12 years in prison on August 2005. An 11-year supervised release term began in 2015, which included provisions that barred Statts from drinking alcohol or possessing controlled substances.
Statts' arraignment is scheduled at 1:30 p.m. on Oct. 16 before Kanawha Circuit Judge Charles King.
An indictment doesn't mean a person is guilty of committing a crime; it just means a grand jury believes there is enough evidence to warrant a criminal trial.
