Charleston man charged in connection with fatal crash in Elkview

A Charleston man who allegedly killed another man in a wreck in March was arrested Wednesday.

Kevin Statts, 54, was driving on Frame Road in Elkview when he crossed into another lane and crashed into a vehicle driven by James Kidd, who died at the scene, according to a criminal complaint filed in Kanawha County Magistrate Court.

"There were no pre-impact skid marks or any other evidence to suggest that Mr. Statts attempted to avoid the crash or perform any crash avoidance maneuvers," the complaint states.

Statts later registered above .08 percent blood-alcohol level on a breath test, according to the complaint.

Kanawha County sheriff's deputies arrested Statts on Wednesday on a charge of driving under the influence causing death.

He was already under supervised release after U.S. District Judge John Copenhaver Jr. sentenced him in August 2005 to 12 years in prison for conspiracy to manufacture methamphetamine and possession of a firearm in furtherance of a drug trafficking crime.

The 11 years of supervised release started in 2015, according to a petition for a warrant filed in the U.S. District Court for the Southern District of West Virginia.

Statts was barred from drinking alcohol or possessing controlled substances during his release, the petition states.

The recent crash sent Statts to the hospital, where a toxicology test revealed the presence of amphetamines, opiates, ecstasy and a benzodiazepine, according to the petition.

He remained at South Central Regional Jail in lieu of a $100,000 bail Thursday morning. He is also being held by the U.S. Marshals Service without bond.
